1. Account Terms

As a Componentful user:

• 1.1 Account Security: You are responsible for maintaining the security of your account and any associated activation codes. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
• 1.2 Account Activity: You are responsible for all content and activity that occurs under your account.
• 1.3 Legal Use: You may not use the Service for any illegal purpose or to violate any laws in your jurisdiction (including but not limited to copyright laws).
• 1.4 Human Users Only: Accounts registered by “bots” or other automated methods are not permitted.

2. Design Use and Restrictions

• 2.1 Permitted Use: You may use the designs for personal or commercial projects, including but not limited to creating prototypes, designing apps, websites, or other products for your clients.
• 2.2 Prohibited Use: You may not resell, redistribute, or otherwise share the design components as standalone files with others, whether for free or for profit. This means that while you can incorporate the designs into your own or your client’s projects, you cannot sell or give away the design components themselves as independent products.
• 2.3 Intellectual Property: The designs provided by Componentful are the intellectual property of the Company. By purchasing a design, you are granted a non-exclusive, non-transferable license to use the design according to these Terms. This license allows for commercial use within the scope of your projects, but does not permit the resale or redistribution of the design components themselves.

3. Payment and Access

• 3.1 One-Time Payment: Some designs require a one-time payment to access. Once purchased, you will have access to all free and Pro designs as long as the Service is provided by the Company.
• 3.2 No Refunds: All sales are final. We do not offer refunds for any purchases made through the Service.

4. General Conditions

• 4.1 Service at Your Own Risk: Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis.
• 4.2 Third-Party Vendors: The Company uses third-party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
• 4.3 Prohibited Actions: You must not modify, adapt, or hack the Service or modify another website to falsely imply that it is associated with Componentful.
• 4.4 No Reproduction or Exploitation: You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without the express written permission of the Company.
• 4.5 Abuse and Harassment: Any form of abuse, including verbal, physical, written, or other abuse (including threats), directed towards any Service customer or Company employee will result in immediate account termination.
• 4.6 Technical Transmission: You understand that the technical processing and transmission of the Service, including your content, may be transferred unencrypted and involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices.
• 4.7 No Warranty: The Company does not warrant that (i) the Service will meet your specific requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations, and (v) any errors in the Service will be corrected.
• 4.8 Limitation of Liability: You expressly understand and agree that the Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of the Service.

5. Intellectual Property and Copyright

• 5.1 Entire Agreement: The look and feel of the Service, including the designs provided, are copyright to Componentful. All rights reserved. You may not duplicate, copy, or reuse any portion of the HTML, CSS, JavaScript, or visual design elements without express written permission from the Company.

6. Final Provisions

• These Terms constitute the entire agreement between you and Componentful and govern your use of the Service, superseding any prior agreements between you and the Company.
• The failure of the Company to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision.
